Terms of Use

Last updated:

1. About Swipe Drive and these terms

Swipe Drive is a trading name operated by an individual in the United Kingdom. These terms cover the Swipe Drive service at swipedrive.co.uk and swipedrive.uk. Contact us at swipe.drive@outlook.com.

By using the service you agree to these terms. Additional Marketplace Terms, Dealer Terms and Payments, Cancellations & Refunds apply where relevant. Our Privacy Policy explains how we use personal information.

2. Our role in vehicle transactions

Swipe Drive is an advertising and matching platform. We are not the buyer, seller or dealer of any advertised car, a finance provider, or a party to the eventual vehicle sale contract. Browsing and saving cars is free.

The buyer and seller arrange the transaction directly. Buyers should independently check the seller, ownership, vehicle condition, history, mileage, roadworthiness, description and payment arrangements before buying. Sellers remain responsible for their legal obligations.

Listings and third-party information are supplied by others. We may moderate content, but do not guarantee its accuracy or that every listing or seller is legitimate. A match score, placement, badge or save is not an inspection, warranty, endorsement or guarantee of a sale.

3. Accounts and your responsibilities

Provide truthful account information, keep it up to date, and keep your password and access credentials secure. Do not share access in a way that allows unauthorised use. Tell us promptly if you suspect your account has been compromised.

You are responsible for content and activity you authorise through your account. Do not impersonate another person or business, misrepresent your account type, create accounts to evade a restriction, or advertise cars you have no authority to advertise.

4. Acceptable use

Do not use Swipe Drive for fraud, misleading advertising, unlawful content, harassment, threats, rights infringement, spam, or collecting other people's information without authority.

Do not introduce malicious code, attempt unauthorised access, interfere with security or availability, manipulate analytics or payments, scrape the service or use unauthorised automated access. An expressly authorised stock feed is subject to the Dealer Terms and the permission agreed for that feed.

We may investigate suspected breaches, request clarification, temporarily hide or restrict content, suspend accounts, or terminate access for serious or repeated misuse. We will act proportionately, taking account of urgency and legal obligations. We may use reasonable technical measures to prevent repeated access following serious or repeated breaches. You can contact us to ask for a review.

5. Content, branding and third-party links

Swipe Drive's branding, software and other materials belong to us or our licensors. These terms allow ordinary use of the service; they do not transfer ownership or allow unauthorised copying or commercial reuse.

You retain your rights in uploaded content. You must own it or have permission to use it, including photographs, logos, descriptions and trademarked material. You grant us a non-exclusive licence to store, display, format and reproduce that content as reasonably needed to operate and promote your listing through Swipe Drive, including any authorised stock feed. This does not grant us ownership of your content.

We may remove content following a credible rights complaint. External websites, social platforms, dealers and Stripe have their own terms and policies; we do not control those services.

6. Availability and liability

We aim to provide a reliable service, but interruptions, maintenance and third-party outages may occur. We do not promise uninterrupted availability, enquiries or a successful sale. We may make reasonable service changes, with notice where a material change affects a paid service.

We are responsible for loss caused by our breach or failure to use reasonable care where the law requires. For consumers, we do not exclude liability for reasonably foreseeable loss caused by that failure. For business users, to the extent lawful, we exclude indirect or consequential business loss and loss of profit, revenue or business opportunity.

Nothing excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or anything that cannot legally be excluded or limited. Your statutory consumer rights are unaffected.

7. Changes, complaints and governing law

We may update these terms to reflect the service or legal requirements. We will provide reasonable notice of material changes affecting an existing paid agreement and explain when they take effect. Changes do not remove rights you already have.

For questions, complaints or a review of a restriction, email swipe.drive@outlook.com with the relevant account or listing details. Do not send passwords or full card details.

These terms are governed by the law of England and Wales. This does not remove mandatory consumer protections or your right to bring a claim in the courts of the part of the UK where you live. For business agreements, the courts of England and Wales have jurisdiction, subject to any mandatory applicable law.
